“Philip C. Jessup国际法模拟法庭比赛”队员招募启事

   “Philip C. Jessup国际法模拟法庭比赛”(以下简称为Jessup)是由“美国国际法学生联合会”(International Law Students Association,ILSA)主办的专业性法律模拟法庭比赛。在1960年由哈佛大学创办,至今已有逾50年的历史,是目前国际上规模最大、历史最悠久的专业性辩论赛,每年都吸引了世界上各著名法学院参加,参赛国已将近100个,参赛学校也已经达到800多个。 

    Jessup旨在全球范围内推动对于国际公法的学习与研究,并通过模拟国际法庭审判来加强学生对法律的深入理解、提高法律研究与写作能力、培养优秀的庭辩技巧。Jessup比赛并为同学提供与国际知名法官、律师、学者交流与学习的机会,对同学们的职业发展有利的帮助。采用海牙国际法院(International Court of Justice)的开庭方式,由起诉方和应诉方分别向法官陈述并解释自己应当胜诉的事实依据和法律理由。比赛要求各参赛队伍充分研究案例事实(Compromis),对所给案例中包含的相关国际法理论和规则进行分析与研究,以英文为工作语言,同时为原告与被告起草起诉状和答辩状,并就该案件代表双方进行口头辩论。

    整个比赛首先将在ILSA的授权下在各地区或国内进行优胜选拔;依据各地区或国内比赛的参赛队数量将有一定比例的代表队有资格代表本国,晋身美国华盛顿特区举办的国际总决赛。2016年中国赛区选拔赛将于2016年二月在苏州大学举办。英美法班二、三年级同学组成的2015 SHUFE代表队在今年于人大举行的比赛中获得了二等奖的好成绩。

Jessup Club:
Jessup Club 对全校开放,将定期组织讲座、公开课、工作坊等介绍Jessup,帮助会员提高英文法律写作、研究、庭辩能力,及对国际法的兴趣。
队员选拔程序:
1. 请在3月16日之前邮件至:zyqycyt@qq.com,或jessupshufe@163.com。请写明姓名及联系方式。
2. 你将会收到几年比赛的材料,以及基本的写作、研究和庭辩的材料
3. 你将有两周准备一份法律诉状和10分钟的庭辩。
4. 庭辩面试将由指导老师与参赛队员进行。
5. SHUFE Jessup将综合评估写作与庭辩,在三天之内公布新队员名单。

Jessup is the oldest and most prestigious international moot court competition. First held on Harvard campus in 1960, it has seen aspiring students from more than 800 law schools from more than100 countries. The objectives of the competition are to promote the understanding of international law, and to a broader perspective, to offer law students a highly competent forum to horn their learning of critical legal skills. Many students who came through the competition went on to become important jurists, lawyers and policy makers, some serving now on the International Court of Justice (ICJ).

2016 China competition will be held in Suzhou in Feb, 2016. The top five teams will advance to Washington grand final round.

Format of competition:
The competition is a simulation of the appeal of a fictional dispute before the ICJ. You are expected, as the attorney, to produce a persuasive legal brief for the court. You will then be called upon to a 40 minutes court argument before a panel of judges from around the world. You will be rigorously questioned during your arguments.

Training strategies:
Each week, the team members are expected to deliver a writing and an oral presentation on relevant issues of the law. Seminars and workshops on legal writing, research, oral communication and court presence will be held. You will have ample feedback from International Law faculties and invited practitioners. We will also, of course, help you to networking opportunities.

In addition, there will be a Jessup Club, open to everyone who is interested in the learning of law and the improvement of legal skills.
