On May 12, 2015, Professor Alodo Petrucci, a famous Italian Roman jurist and expert working in University of Pisa, was invited to give a lecture named “The Tradition of Roman Law and the Principle of Circumstance Alternation in Contemporary European Law.” Professor Zhu Xiaozhe in SHUFE Law hosted the whole lecture. Professor Xiao Jun in Shanghai Jiaotong University played a role of translator.
At first, Professor Alodo Petrucci combed the relevant practice about the theory of circumstance alternation in Roman law and he also introduced different solutions in cases of land contracts, sales contracts and agency appointment contracts in Roman law. Besides that, he explained the relationship between the principle of circumstance alternation and that of good faith. After that, we got knowledge about the remedies in case of that it is difficult or a lack of legal basis to carry out the principle of circumstance alternation in Roman law.
In the second part, Professor Alodo Petrucci focused on the different path of inheritance and development of the principle in European countries. In addition, he shared his view of application and limits about the principle in modern European legal system, combining the general principles of international commerce with the relevant provisions in drafts of two European unified law of contract.
Before the end of the lecture, Professor Alodo Petrucci patiently answered the questions from students and teachers. The lecture ended up with warm applause.
