March 17, 2015, 6:30pm, the first 2015 SHUFE Legal Forum was held in Administrative Building where Chairman Ding Wei of LAC of SMPC gave a lecture entitled “several issues about the amendment of Legislative Law”. The lecture was presided by SHUFE President Assistant and Executive Vice-President of Graduate School, Professor Zheng Shaohua.
Ding started with the importance of Legislative Law, to be specific, its importance for the conceptual design of political system reform as well as the rational allocation of legislative power, executive power and judicial power. Ding thought Legislative Law known as minor constitution is a regulation of legislation. Ding himself was involved with all aspects of consideration, first draft, submitting to LAC and other amendment processes and has been keeping constant attention on Legislative Law.
Ding focused on four aspects during the lecture. He introduced the background of starting amendment of Legislative Law, historical status, the importance of amendment and legislative timing of Legislative Law, where Ding thought Third Plenary Session of the Central Committee accelerated legislative progress and Fourth Plenary Session of the Central Committee widened the legislative extent. Secondly, Ding talked about the consideration and amendment of Legislative Law Amendment, where he supposed that there were several material alterations and adjustments in the draft in the process of consideration, 1st and 2nd deliberation of NPC Standing Committee, deliberation of NPC and voting. Thirdly, Ding explained the amendment, including earnest implement of arrangements and decisions of Central Committee, pivot breakthroughs, improvement of legislative quality and institution, active and steady step-by-step advance, and concordance with legal system. Fourthly, Ding analyzed the amendment about its main content and six aspects, such as improvement of legislative system, NPC’s leading role in legislative work, deep promotion of scientific and democratic legislation, improvement of procedures of administrative laws and regulations, strengthening of recording review, supervision on judicial interpretation.
Ding represented solid academic performance and explained profound theories in simple language to give us a very thorough understanding of the legislation evolution and amendment. We think highly of this lecture.
