On March 11th, 2015, the Rule of Legal Fee Payment (exposure draft) Modification Seminar and the Eighth China Law Society Legislators Consultant Conference in 2015 was held in the office of China Law Society. This conference was organized according to the authorization of the state council legislative affairs office. Zhang Wenxian, member of party group of China Law Society, vice president and director of academic committee chaired the seminar.
Prof. Wang Fuhua from Shanghai University of Finance and Economics, Prof. Wang Yaxin and Prof. He Haibo from Tsinghua University, Prof. Xiao Jianguo from Renmin University of China, Prof. Liu Zi from China University of Political Science and Law, Prof. Liao Yongan, dean of Xiangtan University law school, Prof. Wang Xuemian North China Electric Power University, associate professor Lin Jianfeng from Central University of Finance and Economics and other scholars attended the conference and made speech respectively.
Prof. Wang Fuhua made comparison between the compositions of Chinese and foreign of civil legal costs through massive data, and aired view on the transfer of legal cost, and the sharing of legal cost among the nation, society, market and parties. He analyzed the new Civil Procedure Law and the new rule of legal fee in judicial interpretation one by one as well.
Scholars at conference reached the consensus that, it is of great necessity to revise and improve the Rule of Legal Fee Payment implemented from April, 2007 timely according to the development of society and economy, and the practical requirements after the modification of Civil Procedure Law and Administrative Procedure Law. Scholars and experts also raised amending and improving comments and suggestions for the name of the draft, adjustment of charging standard, new charging system, reasonable definition and differentiation of application fee and acceptance fee, special charging and refunding system for public welfare lawsuit and so on.
