In order to learn advanced spirit of the fourth plenary session of the eighteenth central committee and grasp the right direction of future judicial reform, Law School’s Party General Branch invited Mr. Li Guoguang, the ex-vice director of the Supreme People’s Court (SPC), to deliver a special lecture in Wudong 8th terrace classroom on November 11st. The topic was “Rule of Law & Judicial Reform”. Bachelors, postgraduates and some teachers attended the lecture which was hosted by Zhou Jiepu—the Law School’s secretary of the Party General Branch.
The lecture was divided into two parts.
First, Mr. Li stated the long and labyrinthine process of China’s institutionalization combining his long-term law studies and work experience. He was admitted to Peking University Law School in 1956 and he was assigned to the Supreme People's Court of Tibet branch after graduation. Spending 24 years in Tibet, he was promoted to the judge of Shanghai SPC till retirement.
Then, he made a complete and meticulous analysis about the fourth plenary session of the eighteenth central committee with his own experience. The main contents can be summarized to six points. First, the general target of the meeting is to form a system serving “the socialist rule of law with Chinese characteristics” and build a country under “the socialist rule of law”. Second, to realize the rule of law, the country should be ruled in line with the constitution. Third, the system to ensure the implementation of the constitution and to supervise the implementation should be improved. Forth, the National People’s Congress and its Standing Committee should play a better role in supervising the Constitution’s implementation. Fifth, a mechanism will be set up to record officials who interfere in judicial cases and name them publicly to hold them accountable. Sixth, the Supreme People’s Court will set up circuit courts, and the country will explore establishing cross-administrative region courts and procuratorates and seek to allow prosecutors to file public interest litigation cases.
Mr. Li’s analysis was not only organized well but also combined his own experience. It is worth mentioning that Mr. Li’s analysis on judicial reform was not limited into interpreting the jurisprudence,he also quoted lots of fresh cases and abundant life experience to explain the meaning of building a country under the rule of law. Both teachers and students learned a lot from his lecture. And the lecture played an important part in attenders’ understanding the law spirit of the fourth plenary session of the eighteenth central committee
At the end of the lecture, Mr. Li replied part of questions raised by teachers. He emphasized the question about juridical practice especially. The lecture successfully ended in attenders’ warm applauses.
