On the evening of May 8th 2014, the Graduate Association of our college and law school co-hosted the forth lecture of the series of “focus on deep revolution” during "Bloody May” Graduate Cultural Festival. Professor Liu Xianquan, dean of East China University of Political Science and Law, faculty of law, was invited to give a lecture on the theme of “research on hot area in Criminal Law”. Liu was not only the National Model Worker but the only one who came from the education sector and was named the 2013 Top Ten Shanghai Model Worker of the Year of more than 5,000 people in the previous model workers in Shanghai. Chu Hua, secretary of the School League Committee, Zhou Yan, deputy secretary of Party Branch, faculty of law and instructor Zhang Kaijun attended the lecture . Lin Jiayu, the member of the Graduate Association presidium acted as the host.
To begin, Liu mentioned current hot issues of Criminal Law. He expressed the meaning of “the Principle of a Legally Prescribed Punishment for a Specified Crime” as well as the history of the principle of “not guilty without stipulation in explicit terms, not punishment without stipulation in explicit terms”, spreading from western countries to the whole world and being adopted worldwide after being established by French Penal Code, which proved its vitality and scientificity. Meanwhile, He pointed out that during the process of being applied in China, the principle made bias on defendants in reality, because of its emphasis and directivity, which made the modified conception 'assuming disputed crime lighter' become the source of miscarriages of justice . Then, Liu took the case of She Xianglin and Zhao Zuohai (who were innocent but sentenced to the prison) that has set off wide discussions as examples to analyze the drawbacks in the past and progress at present. In addition, Liu also made a comparison about ensuring the purity between China and U.S. by referring to “Simpson” case. Finally, Liu highlighted the necessary to cultivate the spirit of being defendants.
For questions, Liu gave brilliant answers to the questions raised by students, showing his erudition, wisdom and wit again. The lecture last for two hours and ended up with endless thoughts.
