Launched and organized by China’s Law Society, the Outstanding Achievement Award for Young Social Law Researchers is currently the only authoritative selection of academic achievements in China’s social law sociey, being regarded as the highest youth academic award in the legal field. The award aims to encourage and inspire the young social law scholars to hammer at the academic research, and to promote and facilitate the sustainable development of China’s sociological jurisprudence. All monographs or academic papers published before August 15, 2013, with authors or the first co-author born after August 15 of 1968 are eligible for selection. This scholarship set up one first prize, bonuses at $10000 per piece; five second prizes, bonuses at $6000 per piece; 10 third prizes, bonuses at $3000 per piece. 

 

Dr. Wu Wenfang's thesis of “Research on the Regulation Validity and Credit Validity of German Collective Contract” was awarded the third prize. The thesis gives a systematic research on the regulation validity and credit validity of German collective contract, explaining the content and meaning of the theory in a narrative way from the perspective of Chinese law. The thesis argues that our labor law has introduced the concept of regulation validity and credit validity for a long time but lacks a clear recognition of the source, effectiveness and function of it. It goes without saying that credit validity results from the autonomy of the private law while regulation validity roots in the idea of social autonomy which is different from the former one and therefore makes a breakthrough in the private law interpretations. This is also the foundamental distinction between civil law and labor law. Although the theory is not first created in the thesis, the thesis makes the first systematic and in-depth interpretation of the theory among works written in Chinese (including those written by Taiwanese). It has certain practical significance for the perfection of legislation of collective contract in China.
