Professor Mark Poustie, who come from Law School of University of Strathclyde in UK, delivered a lecture to SHUFE Law School students on the theme Comparative Perspectives on the Enforcement of Environmental Law on October 29th, 2013,T2. Professor Mark Poustie was the President of the Law School of University of Strathclyde and now is the Vice-president of the Faculty of Arts in the same university. This year, Professor Mark Poustie was selected into “the Program of Orientalists” held by Shanghai universities and colleges. Dr. Zhao Xiaobo from SHUFE Law hosted this lecture.

With the start of the aims of enforcement, Professor Mark Poustie separately discussed the features of enforcement regimes, approaches to enforcement in practice, trends in enforcement activity and penalties, alternative or complementary approaches, and analyzed the comparative perspectives about the above facts. Then, by comparing a series of images and tables from China and UK, Professor Mark Poustie showed us the obvious differences between China and UK on aspects of the enforcement of Environmental Law and the trends in size of penalties imposed. We can see from the above analyse that the key issues to encourage the enforcement of Environmental Law and approach the ideal legal effects include the clarity in legal framework, relatively independent regulators, reasonable level of enforcement activity in relation to pollution incidents, and appropriate range of penalties which will punish and deter, etc.

 

At the end of the lecture, many SHUFE Law School students discussed and exchanged their opinions with Professor Mark Poustie on the problem of the enforcement of environmental law and the approach to protect our environment by administrative law, which presenting a warmly and lively discussing atmosphere.
